Means addresses located within 50 miles of our nursery locations, subject to product, vehicle and delivery requirements.

Means the plants, trees, shrubs, hedging, landscaping products and other goods supplied by us.

Order
Means your request to purchase products from us.

Basis of Sale

Product Information

The quality, quantity, price and description of products supplied will correspond with the details shown on our website or, for telephone orders, those confirmed to you in writing.

Delivery Area

We currently offer delivery within a 50-mile radius of our nursery locations. Please check that your delivery address falls within our delivery area before placing your order.

For larger, specialist or particularly heavy products, additional delivery requirements may apply.

Product Images & Descriptions

We make every effort to ensure that product descriptions and images are accurate. However, plants are living products and naturally vary in colour, shape, form and size.

Images are therefore intended as a guide and the plant supplied may differ slightly from the image shown.

We may update website information, descriptions, specifications and images where necessary.

Plant Sizes

Plant sizes stated on our website are approximate. Natural growth and seasonal conditions mean that individual plants may vary in size.

Plants may also develop differently depending on the time of year they are purchased.

Acceptance of Orders

All orders are subject to product availability and our acceptance.

A contract is formed when we confirm acceptance of your order, normally by email. If we are unable to accept your order, any payment already taken will be refunded.

If you wish to change an order after placing it, please contact us as soon as possible.

We will advise whether the requested change can be accommodated and whether it affects the product price, availability or delivery arrangements.

Delivery & Packaging Charges

Delivery charges may apply depending on your order, delivery location, product type and delivery method.

For larger plants, trees and specialist orders, delivery may require a bespoke quotation. If the actual delivery cost differs from the amount displayed online, we will contact you before processing the order.

Payment

Payment is taken when an order is placed using the payment methods available on our website.

If we are unable to accept your order, any payment taken will be refunded.

You are responsible for ensuring that the payment and contact information provided is accurate.

VAT

All applicable VAT will be charged at the prevailing rate.

If the applicable VAT rate changes between the date of order and the date of supply, the amount payable may be adjusted where legally required.

Pricing Errors

If a product is incorrectly priced on our website, we reserve the right to correct the error before accepting your order.

Delivery

Delivery Address & Instructions

Orders will be delivered to the address provided when placing your order.

It is your responsibility to provide an accurate address, postcode and any relevant delivery instructions.

Please ensure that the delivery location is reasonably accessible and suitable for the size of the delivery vehicle required.

Delivery Times

We aim to dispatch orders as quickly as reasonably possible. Delivery times vary according to product type, availability, season and delivery method.

Pre-order, bare root, root ball and specialist products may have different delivery timeframes.

Delivery Delays

We work with specialist delivery providers and carriers. Although we will make every reasonable effort to meet agreed delivery times, delays can occasionally occur due to circumstances outside our reasonable control.

Where a significant delay occurs, we will contact you where appropriate and work to arrange a suitable alternative delivery date.

Failed Deliveries

Deliveries are generally made on a no-signature-required basis.

Please provide clear and reasonable delivery instructions at checkout if you are not going to be present.

If delivery cannot be completed due to inaccurate information, unsuitable access or other circumstances within your control, additional delivery or storage charges may apply.

Pallets & Specialist Deliveries

Some products are delivered on pallets or using specialist vehicles.

Pallets and packaging will normally remain at the delivery address. Drivers are not responsible for planting, positioning plants within the garden or disposing of packaging materials.

For large or heavy plants, suitable access and, where necessary, lifting equipment must be available at the delivery location.

Risk & Ownership

Responsibility for Products

Responsibility for the products passes to you when they are delivered.

From that point, you are responsible for appropriate handling, planting, watering, maintenance and general care of the plants.

Ownership

Ownership of the products passes to you once we have received payment in full for the relevant order.

Legal Restrictions

Certain plant species may be subject to legal restrictions relating to where they can be planted or how they can be used.

Where applicable, it is your responsibility to ensure that plants are used and planted in accordance with all relevant legislation and regulations.

Quality & Returns

Product Quality

We take care to inspect plants and other products before dispatch and aim to ensure that all orders meet the description provided at the time of purchase.

If your order arrives damaged, incorrect or does not conform to the contract, please contact us as soon as possible.

Incorrect or Damaged Products

If you receive an incorrect or damaged product, please contact our team promptly and provide photographs showing the product and any relevant damage.

This will allow us to assess the issue and advise you on the appropriate next steps.

Plants & Perishable Products

Plants are living and perishable products. Specific cancellation and return rights may therefore differ from those applicable to non-perishable goods.

Nothing in these Terms affects your statutory rights.

12-Month Plant Guarantee

Eligible plant purchases may be covered by our 12-month plant guarantee, subject to the qualifying conditions and terms of the guarantee.

Statutory Rights

Nothing in these Terms is intended to limit or remove any statutory rights you have under applicable UK consumer law.

Your Right To Cancel

Cancellation

Depending on the circumstances and the type of product purchased, you may have legal rights to cancel your order.

These rights may differ for living or perishable products and for products that have already been planted, used or altered.

You should contact us as soon as possible if you wish to cancel an order.

Changes of Mind

Where a statutory cooling-off period applies to your purchase, you may have the right to cancel within the applicable period.

Certain products may be excluded from cancellation rights under applicable consumer legislation.

Returning Products

Where you are entitled to return products, we will advise you of the appropriate return or collection arrangements.

We are not responsible for the content or accuracy of third-party websites linked from our website.
